Cornish Marine – Consumer Terms and Conditions of Supply

Definitions

In these terms and conditions:

A. We / Us / Our / Supplier refer to Cornish Marine
B. You / Your refer to the purchaser of any goods or services from us
C. Contract means the agreement between you and us for the supply of goods or services
D. Goods mean any goods or services ordered from us
E. Order means any order placed by you with us
F. Consumer means any individual acting for purposes wholly or mainly outside their trade, business or profession

If you purchase goods or services other than as a consumer (for example, as a business):

1. Format of the Contract

1.1 These terms apply to all goods and services supplied by Cornish Marine (“the Supplier”).
1.2 No contract exists until we have received and accepted your order.
1.3 Acceptance will normally be confirmed by email. We reserve the right to cancel the contract if goods are unavailable, incorrectly priced, or cleared funds are not received.
1.4 The contract is subject to your right of cancellation (see Section 6).
1.5 We may amend these terms for future sales without notice.
1.6 Your order constitutes an offer to purchase goods at the stated specification and price.
1.7 Where possible, acceptance will be confirmed by email, forming a binding contract.
1.8 If we cannot accept your order as placed, we will notify you and may offer alternative terms.
1.9 A contract is formed only when such alternative terms are accepted by you.

2. Description and Price of Goods

2.1 Descriptions and prices are as shown at the time of ordering.
2.2 All goods are subject to availability. If goods become unavailable after acceptance, we may cancel the contract and issue a full refund.
2.3 If a pricing error is identified, we will notify you and offer the option to proceed at the correct price or cancel for a full refund.
2.4 Delivery charges may apply and will be shown at checkout or agreed separately.
2.5 Specifications and prices may change due to market conditions.

3. Payment

3.1 Payment is due in full prior to dispatch or supply unless otherwise agreed.
3.2 Goods will not be supplied until cleared funds are received.
3.3 Payments must be made without deduction unless required by law.
3.4 No surcharge is applied for card payments.
3.5 An invoice will be issued electronically upon completion of your order.

4. Delivery

4.1 Goods will be delivered to the address provided. Delivery outside the UK may not be available.
4.2 Orders placed before 1pm will normally be dispatched the same or next working day, subject to availability.
4.3 If delivery is delayed, we will inform you as soon as practicable.
4.4 If you fail to accept delivery, we may store or resell the goods and recover reasonable costs.
4.5 If cancellation occurs under consumer regulations, refunds will be made within 14 days subject to goods being returned.
4.6 Delivery times are estimates only and delays do not constitute grounds for compensation.
4.7 Goods must be checked on delivery. Any damage should be noted or delivery refused where possible.

5. Risk and Title

5.1 Risk passes to you upon delivery.
5.2 Title does not pass until full payment has been received.
5.3 We may recover payment even if ownership has not passed.

6. Cancellation

Your Right to Cancel

6.1 You may cancel a distance order within 14 days of receiving the goods.
6.2 Cancellation must be confirmed in writing (email or post).
6.3 You are responsible for returning goods unless faulty or misdescribed.
6.4 Refunds will be processed within 14 days of cancellation.
6.5 We may recover reasonable costs if goods are not returned.
6.6 Certain goods (e.g. sealed software or consumables) are excluded from cancellation rights unless faulty.
6.7 Goods must be returned complete and in reasonable condition.
6.8 Return costs are your responsibility unless the goods are faulty.

Our Right to Cancel

6.9 We may cancel if goods cannot be supplied for reasons beyond our control.
6.10 A full refund will be issued with no further liability.

7. Warranty and Guarantee

7.1 Goods are supplied with a six-month return-to-base parts and labour warranty, unless stated otherwise.
7.2 The warranty excludes wear and tear, misuse, unauthorised repair, or failure to follow instructions.
7.3 Damage in transit must be reported within 7 working days.
7.4 Warranty issues must be reported promptly in writing.

8. Limitation of Liability

8.1 We are not liable for losses that are unforeseeable or not caused by our breach.
8.2 Nothing limits liability for death, personal injury, or fraud.
8.3 Our maximum liability is limited to twice the value of the goods supplied.

9. Data Protection

9.1 We take reasonable steps to protect your data but are not liable for unauthorised access unless negligent.

10. Images

10.1 Images are for illustration only and may differ from supplied goods.

11. Statutory Rights

11.1 These terms do not affect your statutory consumer rights.

12. Your Responsibilities

12.1 You are responsible for ensuring goods are suitable and compatible.
12.2 You are responsible for correct installation unless agreed otherwise.

13. Law and Jurisdiction

13.1 These terms are governed by English law and subject to the jurisdiction of the English courts.
